Terms and Conditions for Internet Services

Please read this agreement carefully

  1. Acknowledgement and Acceptance of Terms of the Service
  2. Websumu Internet Solutions (hereinafter referred to as "Websumu") is a trading name operated by Infold Limited ("Infold"), and is a provider of internet related services("Services"). The Services are provided to you ("Client") under the terms and conditions of this Terms and Conditions ("T&Cs") and any operating rules and policies that may be published by Infold, Nominet, ICUK, MEMSET, TUCOWS, and any other suppliers that Infold may use.

    By completing the Registration Application and submitting it or by agreeing to take our Services by  email, you agree to be bound by the T&Cs of Websumu. 

    By  registering .uk domain names through Websumu services, you agree to Nominets domain name registration T&C's found here.

    Websumu reserves the right to alter these T&Cs in any way without the consent of the Client.

  3. Charges
  4. Charges for the Service will be due in advance and payable monthly or yearly by the following methods:

      • Cheque
      • Direct Debit Mandate

  5. Description of Service
  6. Websumu provides the Service to the Client via its own equipment and third party internet service providers. Websumu reserves the right to improve, correct or modify all or any of the equipment, software and third party services from time to time. We will endevour to notify the Clients in advance where it is reasonably practicable. 

    Each Internet provider that we use to provide your Services, owns, maintains, and supports its own service. Availability of an Internet service is the responsibility of the Internet provider. We do not own or control all of the various facilities and communication lines through which access may be provided. Accordingly, we shall not be responsible for user/access security.

    However, we will assist in network security breach detection and identification and in establishing limited access when requested.


    The Client expressly agrees that the use of the Service is at Client's sole risk. The Service is provided on an 'as is' and 'as available' basis.

    Websumu makes no warranties or conditions, express or implied, including the implied warranties or conditions of merchantability, quality and fitness for a particular purpose relating to the Service.

    Websumu makes no warranty that the Service will meet Client's requirements, or that the Service will be uninterrupted, timely, secure, or error free.


    Websumu is not liable for special, direct, indirect, or consequential damages, resulting from the use or inability to use the Service even if Websumu have been advised of the possibility of such damages including, but not limited to, lost profits, lost business revenue, or failure to realise expected savings.

    Websumu shall not be liable for any claims against you by any third party.

  7. Client's Responsibility
  8. You agree:

    1. that Websumu may use your name, user identification and other identifying information in Websumu's service directory,
    2. not to assign, or otherwise transfer, this Agreement or you rights under it, delegate your obligations, or resell the Service. Any attempt to do so is void;
    3. that you are responsible for the results obtained from the use of the Service;
    4. to obtain, install, and maintain suitable equipment and software as necessary to access the Service;
    5. to obtain all required permissions if you use the Service to receive, download, display, distribute, or execute programs or perform other works;
    6. to comply with all applicable laws, regulations, or conventions including those related to data privacy, international communications, and exportation of technical or personal data;
    7. to give all required notices under this Agreement by sending an electronic or written notification;
    8. to pay charges for all Service usage you incur. Failure to pay promptly may result in cancellation of your access to the Service. If you terminate this Agreement, all charges incurred will be payable in full;
    9. not to use this Service to interfere or attempt to interfere with the use of the Service and/or the Internet by any other party;
    10. to provide Websumu with the requested identification when requesting password change or in connection with other security related matters.
    11. to notify us immediately on becomeing aware of any unauthorised use of any of our Service to you.
    12. not to use our system for any unlawful purpose or for the publication, linking to, issue or diisplay of any unlawful material, including any pirated software,  or material which is obscene, pornographic, threatening, malicious, harmful, abusive, defamatory, sexist,.
    13. not to breach Intellectual Property Rights of any third party.
    14. not to carry out activity which would create virus, worm, trojan horse or other harmful code.
    15. to keep us informed of any changes to your contact details.

  9. Our Responsibilities
  10. We will:

    1. provide you all the necessary details to enable you access to the Service;
    2. provide you electronic or written notice if we change or terminate this Agreement, substantially alter the service from its current description, increase service charges, or change invoicing procedures. Such changes shall be effective immediately;
    3. provide access to the current Agreement and any succeeding Agreement, if applicable so that you may retrieve it or view it on-line.
    4. provide support to the Client for the Service set out in this Agreement only during support hours Monday to Friday 10:00am to 17:00pm. You may contact us as stated on our Contact Us page.

  11. General Terms
  12. Each of us agrees that:

    1. all information exchanged by both of us is non-confidential. Section 8 of this Agreement describes our responsibilities for handling data and information you transmit over our network using the Service;
    2. any terms varying from this Agreement in any order, written or electronic communication from you are void;
    3. neither of us grants the other any licenses under this Agreement; and
    4. if any provision of this Agreement is determined to be invalid, all other provisions shall remain in force.
    5. Annual Account Holders

    6. if a Client decides to subscribe for a full year to any of our Services and within that period decides to terminate the agreement, unless we are in breach of this agreement, we will not refund any outstanding monies held against that account.

      Monthly Account Holders

    7. Either party may terminate this Agreement, with or without cause, if the customer has subscribed to the monthly payment plan and by giving notice to the other, in writing and in such case the Agreement will terminate at the end of the month or when the monthly payment expires.

  13. Electronic Communications
  14. Each of us may communicate with the other by electronic means as described in this Agreement and its registration information. Each of us agrees to the following for all electronic communications:

    1. a User Identification, contained in an electronic document, is legally sufficient to verify the sender's identity and the document's authenticity;
    2. an electronic document that contains a User Identification, is a signed writing;
    3. an electronic document, or any computer printout of it, is an original when maintained in the normal course of business.

  15. Customer Transmitted Data

    We agree to respect the confidentiality of your information, including programs and data, transmitted electronically over our network while using the Service. However, we have no obligation of confidentiality relating to your information, including programs and data, which is not confidential.

    We also have no liability for any disclosure of information that occurs as a result of our delivery of your information, at your direction and to a recipient you designate, when the delivery is made in the normal course of service provision (for example, to an incorrect delivery address provided by you to us). We may disclose information to the extent required by law.

    Handling of your information

    You are responsible for selection and use of the security facilities and options that we provide.

    You are responsible to develop and maintain procedures (apart from the Service) to protect your information. You are responsible for backup and restoration of your information.

    For transmission carried over interexchange carriers' and local exchange carriers' facilities, we are not responsible for transmission errors, or corruption or security of data.

  16. Service Availability and Access
  17. This Service is generally available daily, seven days a week, except for maintenance.

    We may at anytime without notice or liability restrict the use of the Service or limit its time of availability due to any of the following events:

      • scheduled or unscheduled upgrade or maintenance of infrastructure
      • order from competent authority to carry out compliance and security work
      • failure to pay any fees owing to Websumu by the Client
      • breach of our Service conditions by the Client
      • Client continuously uses above the agreed level of bandwidth and disk space

    We also reserve the right to withdraw the Service from you if your use of the Service, in our opinion, is disruptive, causes a malfunction of the Service or violates the terms of this Agreement.

  1. Domain Services

    Websumu will provide the Domain Services to the Client upon the Terms  and Conditions set ou in this Agreement.

    The Client acknowledges  and understands that the services in respect of domain registration and renewal are limited to forwarding the application to the relevant naming authority. For the avoidance of any doubt, it shall remain the sole responsibility of the Client to verify if the requested Domain has been successfully registered with the appropriate authority.

    Registration:  You undertake and warrant to Websumu that the registration of any domain name and the manner in which it is directly or indirectly used will not infringe any third party rights; and it is not being made in bad faith or could be considered to be an abusive registration under the relevant registration authority's dispute policies and procedures; and  that it will at no time whatsoever be used for any unlawful purpose.

    The Client acknowledges that whilst Websumu will use its reasonable endeavours to register a Requested Domain (Domain), we will not be obliged to accept any request to register or continue to process any registration of a Domain where such a Domain has not been capable of registration. 

    Upon successful registration, Websumu will use reasonable endeavours to notify the Client of any renewal dates vi the email address provided to us at registration.

    Websumu makes no representation of warranties (expressed of implied) of any kind that a Domain is available for registration or to the likelihood of a registration being successful. The Client acknowledges that the registration of the Domain will be subject to any registration requirements of th appropriate registry. 

    The Client will at all times comply with the terms and conditions applying to the domain name registrations published by the relevant naming authority (including the domain dispute resolution policy of that authority) and any other authority having similar force.

    Naming Authorities Terms:

    By registering a .uk domain name, you enter into a contract of registration with Nominet UK on the terms and conditions as shown on their website  at www.nominet.org.uk/nominet-terms. For information on resolving domain name disputes, visit www.nominet.org.uk/disputes/drs/policy.

    For .com, .net, .org domain name registrations, transfers and disputes, visit www.icann.org

    Renewal: All Domain names are renewed on an annual basis unless agreed otherwise. We will send out reminder email 30 days before expiry of the Domain to the email address we have on our records, it is the registrants responsibility to keep us informed of their most current contact details.  Websumu takes no responsibility if your domain renewal fails due to your contact details being incorrect, late payments received or technical faults which are beyond our control. 

    All Domains will automatically be renewed for the same period that they were originally registered for by default. If you do not wish to renew a domain please make sure you notify us a minimum of 14 days before the expiry by emailing us at hostadmin@websumu.net. 

    All renewals will be billed upon successful renewal. Payment will be taken from the payment method you have last used on the account. This could be PayPal, Direct Debit, Cheque.

    If you do not renew your domain before its expiry date, it will have all services such as email and  website, that we provide, suspended and you will have up to 30 days (protected period) after which the domain name can be renewed at the original renewal fee.  For renewal after 30 days, the Client will pay 75 + VAT redemption fee in addition to the renwal fee. Websumu will not guarantee successful renewal of a domain name if the renewal request is received from the Client after 60 days of expiry.

    Transfer: To transfer a .uk domain name to different registrar, a transfer out fee of 15 + VAT will be incurred by the Client payable to Websumu. The transfer of .com, .org, .net is free and needs to be started by the destination registrar. We will provide the required authorisation code upon request to complete the transfer. 

    By transferring out the domain to a registrar of your choice, your service with Websumu will terminate.
